These Terms of Service apply to all customers, prospective customers, website visitors, and any individuals who opt in to receive communications from Glass n Tint, including SMS messages, emails, phone calls, and voicemail.
2. Eligibility & Age Requirement
Age Restriction
By using Glass n Tint's services, accessing our website, or communicating with us, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into this agreement.
If you are under 18 years old, you may not use our services, request appointments, or provide personal information to Glass n Tint. Parents or legal guardians may not use these services on behalf of minor children without prior written consent from Glass n Tint.
Verification
Glass n Tint reserves the right to request proof of age at any time. We may cancel services or terminate your access if we determine you do not meet the age requirement.

Glass n Tint provides mobile automotive glass and window tinting services in California. Our services include:
Automotive Glass Services: Glass repair, replacement, and installation for vehicles
Window Tinting Services: Professional window tinting application and installation
Service Communications: SMS appointment reminders, confirmations, service updates, and order status notifications
We operate as a mobile service provider, traveling to customers' locations to perform services. All services are performed by trained, professional technicians in accordance with industry standards and applicable laws.
4. User Responsibilities
When you use Glass n Tint's services or communicate with us, you agree to:
Accurate Information
Provide accurate, current, and complete information when requesting services or communicating with us

Notify us immediately if any information changes
Lawful Use
Use our services for lawful purposes only

Payment Terms
Payment is due upon completion of service, unless other arrangements are made in writing
We accept cash, check, credit card, and other agreed payment methods
Late payments may incur interest charges as permitted by law
Overdue invoices may result in suspension of services and collection action
Billing Disputes
Report any billing discrepancies within 30 days of the service date

Refunds & Cancellations

Warranties that services will be uninterrupted, error-free, or virus-free

RESULTS NOT GUARANTEED
We do not guarantee specific results from our services. Professional workmanship standards are applied; however, factors beyond our control may affect outcomes.
THIRD-PARTY SERVICES
Glass n Tint is not responsible for the performance, content, or services provided by third-party platforms, including GoHighLevel, payment processors, appointment systems, or any other tools we use to serve you. You use third-party services at your own risk and should review their respective terms and privacy policies.
VEHICLE CONDITION
Glass n Tint is not responsible for pre-existing damage to vehicles, hidden defects, or damage caused by factors outside our control during service delivery.
9. Limitation of Liability
To the maximum extent permitted by law:
LIABILITY CAP
Glass n Tint's total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid for the specific service in question, or $500, whichever is less.
EXCLUDED DAMAGES
In no event shall Glass n Tint be liable for:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunity
Damage to vehicles or property
Personal injury or bodily harm
Any damages arising from service delays or cancellations
Lost wages or time away from work

These limitations apply even if Glass n Tint has been advised of the possibility of such damages, and even if limited remedies fail of their essential purpose.
10. Indemnification
You agree to indemnify and hold harmless Glass n Tint, its owners, employees, agents, and representatives from any claims, damages, losses, or expenses (including attorney fees) arising from:

Your infringement of third-party intellectual property rights

11. Termination

Glass n Tint may terminate your access to services or cancel future appointments at any time, in our sole discretion, for:

Non-payment or late payment
Abusive or threatening behavior toward our staff
Fraudulent transactions or false information
Conduct that harms our business or reputation
Non-compliance with applicable laws
Any other reason, with or without cause
Effect of Termination
Upon termination, your right to use our services immediately ceases. Outstanding balances remain due and payable. Termination does not relieve you of obligations incurred before termination.
Continuation of Obligations
Sections that address confidentiality, intellectual property, indemnification, limitation of liability, and governing law shall survive termination of these Terms.
12. SMS Messaging Terms
Opt-In Consent
By providing your mobile phone number to Glass n Tint, whether through our website, in person, by telephone, or by text message, you are consenting to receive SMS text messages from us. This SMS messaging program is voluntary, and you will only receive messages after opting in.
Message Types
When you opt in to Glass n Tint's SMS program, you will receive the following types of messages:
Glass n Tint will send you appointment reminders, appointment confirmations, service updates, and overall updates on your order status. These messages help you stay informed about your scheduled services and any important information regarding your glass or tinting service.
Message Frequency
You will receive appointment reminders and confirmations. Message frequency varies depending on your service schedule. If you have an appointment scheduled, you may receive a reminder text 24 hours before your appointment and a confirmation when your service is complete. You may also receive service updates if there are changes to your appointment or order status. Frequency depends on your interaction with our business.
Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Opt-Out Instructions
You can cancel the SMS service at any time. Just text STOP to 657-289-9189. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

You consent to the exclusive jurisdiction of these courts and waive any objection to venue.

Binding Arbitration (Optional)
For disputes that cannot be resolved informally, you and Glass n Tint agree to submit to binding arbitration rather than litigation. Arbitration will be conducted under the rules of the American Arbitration Association (AAA). Each party will bear its own costs, and the arbitrator will award costs and fees as permitted by law.
By agreeing to arbitration, you waive the right to a jury trial and the right to participate in a class action lawsuit.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy (glassntint.com/privacy), constitute the entire agreement between you and Glass n Tint regarding your use of our services and website. These Terms supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether written or oral.
17. Severability
If any portion of these Terms is deemed invalid, unenforceable, or unlawful by a court of competent jurisdiction, that portion shall be severed, and the remaining portions shall remain in full force and effect.
